Panel can't refuse to furnish answer sheet
   
Chennai, Sep 20,2012 : The Madras High Court has said the selection committee of the Directorate of Medical Education cannot refuse to furnish the questions, key answers and answer scripts of examinations conducted for admission of students to medical courses after the entrance exam is over.
   
Citing judgments by the Supreme Court on similar cases, Justice  N Paul Vasanthakumar observed that the selection committee was not entitled to rely on a clause in the prospectus and deny disclosure of documents asked for and said the prohibition would apply only upto the publication of the results of the written test.
  
The petitioner had submitted that an entrance test for admission to Post-Graduate Degree/Diploma/MDS/6 year M Ch (Neuoro Surgery) courses for 2012-13 was conducted on March 4 last. As she was not selected after securing 59.75 marks out of 90, she applied for copies of the question paper, key-answer and her answer script, to ascertain the correctness of the marks awarded. Since there was no response, she filed a writ petition.
   
Relying on a clause in the prospectus, Additional Goverment Pleader P Sanjai Gandhi submitted that no question paper, key-answer and answer scripts could be furnished. Disposing of the petition, the judge also directed the committee to furnish the particulars within two weeks.
